Case law is clear that a marital home is valued as of the date of trial, but appraisals are often done several months earlier. In a volatile market, the marital residence – long thought of as a key marital asset – may no longer steadily increase in value. Problems Assessing Real Estate Value In a September 2008 case, the Complaint for Divorce was filed in September 2006, and the original appraisal of the marital home was completed in April 2007. During the trial, both real estate experts testified that their profession was resisting making adjustments for time prior to early 2008, when housing prices plummeted. The original appraiser updated his report in January 2008 and the value had decreased. The person who wanted to be bought out of the house objected and got his own appraisal in April 2008, which used comparables from the last quarter of 2007. No adjustments for time were made. The original appraiser updated his report for trial in September 2008. Given the post-bubble real estate market at the time, the value had gone down again. In 2020 and 2021, COVID-19 caused a bump in real estate values. As interest rates started to rise in 2022, the market began to slow and prices receded slightly. Was it wise to buy out the other spouse when values were at historic highs? Is it wise to buy out a spouse now, when values are still high, but may be coming down, and rising interest rates may make it more difficult to sell? Key Questions and Areas for Concern • In most cases, appraisals are completed several months before the trial date. • It often takes several months to get a decision in a trial. This calls into question whether the value at trial is a fair assessment for equitable distribution. If the matter is appealed, the value could be further jeopardized. • Does it make sense for one party to keep the house and buy out the other spouse’s interest from the equity or offset the other side’s share of the equity against other non-real estate assets? In a declining market, would it be fairer to sell the house, so that the pain is shared equally, and then divide the rest of the assets? The answer depends on a couple of factors. First, how long does the person getting the house plan to stay? If it is a long time, it may make sense to keep the house; otherwise, the best route may be to sell. Second, how does the sale of the marital property affect the children? It could impact their stability, schooling, and friendships. Rethinking the Home as a Key Marital Asset The equitable distribution statute requires a court to examine the income-producing aspect of the assets received in equitable distribution. This calls into question how a court should look at an asset that could decrease in value for the foreseeable future. Depending on the trajectory of the market, it may be necessary to revise our thinking about what to do with the marital home. After a recent move from Martinsville, the stylist and owner of the salon felt like Bedminster was the perfect spot for her. “I knew I always wanted to be in the beauty industry; I went to cosmetology school after graduating high school,” she says. “I love taking care of people, so I briefly considered going to nursing school but took a leap of faith and haven’t looked back!” She began by shampooing hair when her mom suggested she work at Glamour Shots, doing hair and makeup to get more hands-on experience. Then, after nine years of styling, her boss (and mentor) at the time decided she no longer wanted to own a salon and encouraged Garcia to open her own place. “At the time, I was comfortable styling behind the chair but walked through my fear and pushed myself out of my comfort zone.” Six months later, in November 2017, Beautique Hair Design was officially open. Her old boss joined her and started styling there. “I will always be grateful for that push and the belief she had in me, even before I saw it myself.” Some of her staff, from the time she officially opened, still work for her now, which is a testament to how important relationship building is to her. “I want everyone that walks through our doors to feel welcome, important, and cared for. I want everyone to feel like they are a part of the Beautique family,” adding, “I truly love this industry!” Recent trends Beautique Hair Design has been seeing are “color blocking” (having one area of the hair be one color and the rest another), blunt bob cuts, butterfly layers, bangs, middle-parts, and new technology in curling irons and blow-dryers to repair your hair. The salon has four levels (Rose Quartz, Jade, Amethyst, and Citrine) for the different tiers of stylists. In addition to hair and makeup, there is an aesthetician who offers facials, spray-tanning, and full body waxing. Making people feel glamorous is the best feeling a stylist can get and Garcia especially loves working with clients interested in experiencing hair extensions. One of her most memorable transformations was when she spun a client around and afterwards, she said to her (with tears in her eyes) that she hadn’t felt that beautiful since her wedding day. Experiences like that are an instant gratification for Garcia. “Whether you’ve been in the industry for 2 years or 40 years, your clients need to be offered the latest and greatest. Nothing shortens the lifespan of a fur like keeping it cooped up in the closet during the hot summer months. Home storage – even using air conditioning or cedar closets will not protect your fur from drying out or from dust, dirt, and insect damage. A cedar closet absorbs moisture and will dry out the leather. Professional fur vaults are specially designed environments with carefully controlled humidity and temperature. When furs are not professionally stored, though the fur may not appear to be damaged, the natural oils in the leather may dry out. When the oil diminishes it can prematurely age the garment and leave it more vulnerable to rips and tears. • Fur Cleaning. Furs should be cleaned annually by a fur specialist – never by a dry cleaner for clothes. While fur may not look dirty, it needs freshening to remove particles of dirt on the fur and to keep it soft. The cleaning process – putting oils back into the fur and leather – prolongs its longevity and enhances the luster of the fur. • Fur Care. Avoid shoulder-strap hand bags on a consistent basis as the strap will rub the fur and create bald patches. Avoid getting perfume and hairspray on the fur. Do not treat a fur with mothballs. • When Fur Gets Wet. Most furs can handle some rain and snow. Shake it out and hang it in a well-ventilated room. Never hang the fur near direct heat. Resist the temptation to use a hair dryer on the fur and do not use a brush or comb on the fur. Should the fur get thoroughly soaked, professional treatment by a fur retailer is required. • Closet Space Needed. During the winter, give your fur ample closet space with no exposure to bright light, which can cause fur to oxidize and change color. • Broad Shouldered Hanger. During the fur-wearing season, a fur needs to hang on a broad-shouldered hanger – no wires! A fur retailer can provide one. • Fur Needs Breathing Room. Fur needs air circulation to prevent its leather side from drying out. Never cover fur with a plastic bag. Even when we utilize mental health care, we do it in times of crisis and usually return to habits that jeopardize our emotional and psychological health. As a mental health professional, I introduce Life-Span Therapy to all of my clients. Life-Span Therapy focuses on establishing an ongoing relationship with mental health professionals that helps us traverse the many seasons of life. Humans go through multiple identity transitions throughout our life spans. We occupy many different roles at the same time and these roles get redefined over and over. The internal and relational shifts required to go from single to married, non-parent to parent, parent to empty-nester, stay at home parent to working parent, married to single, or student to worker to boss to retiree, are all seismic. These identity shifts, while natural and expected, are often traumatic. It only makes sense that we should have help as we learn new ways to relate to ourselves and to each other. I want all of my clients to walk away having cultivated a life-long commitment to therapy. I hope that through their work with me they have learned how to use psychotherapy as a permanent fixture in their toolbox for dealing with life. Good therapy is about more than just coping with an immediate stressor. Even in the midst of a crisis, good therapy should lead to lasting growth. This doesn’t mean we never struggle again, it simply means that with each struggle we engage in therapy that helps us make cumulative gains. My time with clients is usually limited and while we often work on current issues such as relationship struggles, struggles with identity, emotional battles and questions of self-worth, one of my major goals is always to help normalize the use of therapy itself. My fantasy is to have a society where it is absolutely normal to have someone who started accessing mental health care while they were a teenager, perhaps dealing with social and academic transitions. After having managed those turbulent years with the help of their family, friends and therapist, that client may once again need to seek out therapy as they get ready to graduate from college or maybe during the first year out as they learn how to relate to themselves and to the world as an “adult.” The next major transition may arrive with impending marriage and that is where premarital counseling would be used to help the couple prepare for the marriage beyond the wedding. As the newlyweds settle into married life, one year in, they may go back to their premarital counselor to reckon with the lessons of the first year and to discuss some concrete steps to safeguard their marriage. Fast forward to a baby and once again, the clients would benefit from seeing a therapist to help them support one another through the newness of parenting, their changing marriage and the all-important postpartum period. And on and on as they go from one transformation to another and try to do it together. What I would love for my clients to internalize is that therapy isn’t just for when life is falling apart. In fact, the best and most effective use of therapy is to use it before things fall apart, to help prevent the crisis. Psychotherapy across the life-span that helps us to prepare for, journey through, and learn from all the transitions we go through as humans is the conversation I most want to start with my clients and the world at large.
