It entices all the senses: the crunch of the leaves under your feet…the crisp autumn air…the spectacular foliage…the cozy sweaters… the apple cider. The best way to immerse yourself in the wonders of the season is to jump in and celebrate the harvest. We have many farms in the area that allow you to get out and pick your own pumpkins and apples. If you do not want to put in the work, the farms have well-stocked farm stands, fun activities and tasty treats to enjoy. Even better, check out a festival celebrating the harvest-Applefest Applefest! One of the largest and most popular in the region happens every year just over the New York border in Warwick, New York. This year’s Applefest Applefest will take place on Sunday, October 6th from 9am-5pm. What began back in 1989 as a local fall festival has grown to be an attraction that draws over 30,000 visitors from all around the area. The Hudson Valley is well known for its extraordinary variety of apples. This festival showcases fall’s best fruit. Admission is free to Applefest Applefest and there is something there for the whole family. Try an Apple Pie Baking Contest (with slices for sale- so judge for yourself!), visit over 200 craft vendors, dozens of food vendors, 50 local non-profit exhibitors, a farmer’s market, a children’s carnival and live music and entertainment on several stages all throughout the day. Applefest takes place in the streets and parks of downtown Warwick so you can easily walk to village shops, restaurants, and businesses. The event is hosted by Warwick Valley Chamber of Commerce and all proceeds benefit the Chamber and about 50 local non-profit organizations. The young and the young at heart love the Carnival in Stanley-Deming Park. Everyone will find something at the Carnival-but leave your pets at home as they are not permitted. The Carnival runs all day Sunday from 9-5 as well as for two special pre-Applefest Applefest evenings on Friday and Saturday from 4-10pm. The Carnival offers a variety of kiddie and larger rides. Wristbands for unlimited rides are available for about $15 (separate wristbands are required for each day.) During Applefest Applefest, there is face painting and a whole host of vendors and family activities in the Carnival area. Feeling competitive? Why don’t you submit an entry in the Apple Pie Baking Contest? No fee or pre-registration is required, and entries will be judged in two age divisions: Junior (Age 7-16) and Adult (Age 17 and older). While that may be the final step if a settlement is not reached, divorce trials are quite uncommon in New Jersey. In fact, in most years, only 2% - 3% of cases are tried. Of those, many settle during the trial or on the proverbial courthouse steps. The system is designed with many opportunities to push matters toward settlement. One family court judge has expressed pride that she has never had a trial. While that might not be ideal because some cases need a judicial decision, the reality is that settlement is the desired goal. Clients are more likely to be satisfied and there is less post-judgment litigation when parties settle matters themselves. There are settlement processes built into the divorce system. The first is mandatory custody and parenting- time mediation. If the parties have children who are not emancipated and there is no written agreement settling custody and parenting-time, this mediation is required. Although this mediation is typically handled by court staff without attorneys present, parties should prepare for it with their attorney before attending. There is also a mandatory Early Settlement Panel (ESP) for financial issues. This generally takes place after the discovery process is complete. Discovery is the exchange of financial and other information and expert reports such as business valuations and real estate appraisals. For the ESP, your case is presented to a panel of two or three experienced matrimonial attorneys who volunteer their time to help settle cases. After reading the written submissions and hearing from counsel, the panelists provide non-binding and confidential settlement recommendations (i.e., the judge doesn’t get to know about them.) There are “Blue-Ribbon Panels” with more experienced attorneys as mediators for more complex cases. If the case isn’t settled at ESP, the next step is mandatory economic mediation for which the first two hours are free. Mediation is a longer format before a neutral who tries to help you settle your case. For complex cases, sometimes we try to bypass ESP and go right to mediation. You don’t need to wait for ESP to go to mediation; you can go at any time by agreement. If the case is not settled after ESP, many counties have Intensive Settlement Conferences (ISC) where the parties spend the day at the courthouse with the judge trying to settle the case. Some judges require you to come back over and over, either to wear you down or because you are getting closer to resolution. Only after all else fails, do you have a trial. As we will write in the next edition, sometimes trials are necessary, but the system provides many off-ramps to settle your case before you get to that point. In the context of tax law, a sunset is an expiration date. The Tax Cuts and Jobs Act of 2017 (TCJA) made significant changes to U.S. tax law which are set to expire or sunset after the 2025 tax year. This type of finite tax change results in a political solution to what is an economic problem. By using a sunset provision, the projected reduction in tax revenues is only modeled by the Congressional Budget Office (CBO) until the sunset date. The CBO projects the 2024 Federal deficit to be about $2 trillion or 7% of gross domestic product (GDP). It is much easier to borrow than to repay. These temporary tax law changes make proactive planning rewarding for individuals, families, and businesses. The TJCA reduced taxes and expanded estate and gift tax exclusions. It also established the qualified business income (QBI) deduction and expanded bonus depreciation. On the flip side, it eliminated the state and local taxes (SALT) deduction (ouch in NJ and NY.) Shapiro CPAs specialize in closely held and family businesses which are organized as a pass-thru entity for income taxes. This includes S-elected corporations, limited liability corporations, and partnerships. These entities incur one level of taxation at the shareholder/partner level. The QBI deduction was enacted to bring the owners of pass-through entities into closer parity with reduced corporate tax rates. This permits up to a 20% deduction of QBI subject to limitations. Extension of this deduction, which can be sizeable for shareholders, is advisable to permit smaller businesses to compete. Pass-thru businesses may also take advantage of NJ and NY workaround provisions to permit the deduction of state income taxes. The sunset of reduced tax rates and the QBI deduction may lead to increased levels of small business sales. The 2024 estate and gift tax exemption of $13.61M per person provides relief and opportunity to many. This window, however, may close at the end of next year and the exemption may revert to prior levels of $5M indexed for inflation. If you wish to provide a greater legacy for your family or have philanthropic motivations, the $18,000 annual gift tax exclusion and the gift of appreciated securities to charity have made this easier to implement. Parents and grandparents may find accelerated 529 gifts appealing, utilizing the 5-year election allowing up to $90,000 in 2024. One potential strategy for larger estates is a spousal lifetime access trust (SLAT). Using a SLAT, married couples can harness the benefits of the current gift tax exclusion while also receiving income distributions. Navigating the tax laws and creating a strategy to benefit from a wide range of potential tax environments takes considerable time, coordination and decision-making. Black Tie: By far the most popular dress code post-pandemic. When an invite says black tie, it means one thing and one thing only-a tux. Black is preferred, but a dark navy or charcoal tuxedo is acceptable. Your bowtie should be black (preferably one you did yourself) and your shirt should have the ability to take both cufflinks and studs, but studs are optional. While traditional black tie is rigid, feel free to inject your personality into your pocket square and socks. As for shoes, patent leather is the norm, but a well-polished black lace-up or loafer is more modern. Creative Black Tie: CBT is the more fun cousin of black tie. In response to this, many schools have implemented policies that restrict the use of AI tools in educational settings through harsh punishments. But we have to ask the practicality of this decision. The topic of how AI should be taught in schools is controversial, but it is evident that we have to reach a certain conclusion in the near future. As the use of AI grows more prominent in various fields, it will become necessary for individuals to possess a certain degree of AI literacy. I predict that this kind of literacy will go above and beyond being beneficial and will become a necessity to thrive in our society. If we neglect to teach AI, it’s akin to someone not learning to use a computer. The impact on skill growth would be significant in both cases. Students cannot learn to use a computer if they never use it. Right? This means that in order to teach AI in schools, we would need to use AI in educational settings. This idea goes against the status quo, which mainly revolves around the hysteria that AI will somehow negatively alter human cognitive growth in students. Biesta’s Theory of Education1 Consideration of the goals of education, as proposed by Biesta, can help assess the role of AI in schools: 1. Understanding: Gaining Knowledge and Skills 2. Socialization: Assimilation of individuals into a society 3. “Subjectification”: Where individuals gain the ability to become independent and autonomous by making their own decisions and thriving in society. How does the introduction of AI satisfy these goals? Individuals gain an understanding of AI, which is a skill that they will use in real-life settings in a variety of ways, whether it is a job that requires you to use AI or simply the process of finding information for yourself. AI can personalize learning for a student. The relationship between the second goal of education and the introduction of AI in schools is complex. While AI use may diminish opportunities for interpersonal interaction, it also offers ways to foster collaboration and combine AI-assisted research with group activities, group projects, and virtual environments. And this process, allows students to share insights and collectively construct knowledge. For the third goal, it is hard to clearly draw a line between good and bad, as there are both good and bad things that can affect individual freedom due to the introduction of AI in schools. On one hand, it could ease the process of navigating the world, thus making individuals more independent and autonomous. But on the other hand, in the process of making them independent, it could make them too dependent on AI.2 In summary, determining the unequivocal impact of introducing this technology into schools is challenging. However, the true benefits will only be realized if we take the initiative to give it a chance. Every innovation carries inherent risks, but historically, embracing risks for the greater good has led to profound advancements. By proceeding cautiously, addressing issues, and focusing on the positive aspects of AI in education, I am confident that it will ultimately prove to be a worthwhile investment.
