When considering a divorce, it is important for a litigant to under- stand the laws regarding alimony in the State of New Jersey. The Court must follow the statutory factors in order to determine the amount and duration of alimony that an individual is entitled to receive or must pay. When the Court is determining the amount of alimony to be paid, some of the major factors that the Court considers are the parties’ ability to pay, the marital lifestyle and the parties’ needs. Therefore, it is extremely impor- tant that individuals use attorneys who are familiar with family law and, specifically dealing with alimony issues, so that the correct financial documentation and accurate Case Information State- ments can be utilized. The laws regarding alimony have been challenged over the past few years. One of the latest changes to the alimony laws pro- vides that, in order to qualify for open durational alimony, which was previously referred to as per- manent alimony, the marriage must be twenty or more years in length. Any marriages that are less than twenty years could qual- ify for limited duration alimony and/or rehabilitative alimony. The statute also provides that alimony ordered by the Court should not exceed the length of the mar- riage, except in extraordinary cir- cumstances. Alimony was previously taxable to the recipient and deductible by the payor. After the most recent change to the Federal tax laws, new alimony obligations, which are established after January 1, 2019, will no longer be taxable and/or deductible. This will create interesting issues when determin- ing alimony since the State has not yet changed the New Jersey tax laws regarding the deductibil- ity and taxability of alimony. Often when parties are self- employed, the issues of alimony become much more complicated due to the fact that experts may be required to determine the accurate income of the business owner to determine the alimony obligation. Thus, it is crucial that a party to a divorce action retain an attorney who has experience dealing with these complex issues in order to determine the appro- priate amount of alimony.
